Please read these terms of service carefully before using Our Service.
1 - Interpretation and Definitions
1.1 - Interpretation
Words with an initial capitalized letter have meanings defined below. These definitions apply whether singular or plural.
1.2 - Definitions
For the purposes of these Terms of Service:
- Account means a unique account created for You to access our Service or parts of our Service.
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
- Application means the software program provided by the Company or Operator, named Hyrr.
- Buyer refers to users who rent Goods ("Renters") or purchase Goods.
- Country refers to United Kingdom.
- Company (referred to as "the Company", "We", "Us", or "Our") refers to Hyrr, 20 Wenlock Road, London, England, N1 7GU.
- Content refers to text, images, or other information posted, uploaded, linked to, or made available by You.
- Country refers to the United Kingdom.
- Device means any device accessing the Service (e.g., computer, cell phone, tablet).
- Feedback means feedback, innovations, or suggestions sent by You regarding the Service.
- Goods refers to items offered for rent, sale, or trade on the Service.
- Hire Fee means the price set by an Owner for renting Goods, excluding taxes or additional charges (e.g., delivery fees).
- Operator (referred to as "the Operator", "We", "Us", or "Our") refers to Hyrr.
- Order means a request to rent, purchase, or trade Goods via the Application or Website.
- Owner refers to users listing Goods for rent (also "Seller" for sales).
- Renter refers to users renting Goods from Owners (also "Buyer" for purchases).
- Replacement Value means the amount set by an Owner, notified to You, representing the cost to replace lost or irreparably damaged Goods.
- Service refers to the Application or Website or both.
- Terms of Service (also "Terms") mean these Terms forming the agreement between You and the Company or Operator.
- Third-party Social Media Service means services or content provided by a third party displayed or made available by the Service.
- Website refers to Hyrr, accessible from www.hyrr.com.
- You means the individual or legal entity accessing or using the Service.

3 - Acknowledgment
These Terms govern your use of the Service and form the agreement between You and the Company or Operator. They outline your rights and obligations.
Your access and use are conditioned on accepting these Terms, which apply to all users. By using the Service, you agree to be bound. If you disagree, you may not use the Service.
You represent you are over the age of majority in your country or the Country (whichever is higher). We do not permit those under this age to use the Service.
Your use is also conditioned on accepting our Privacy Policy, which details how we handle your personal information. Please read it carefully before using the Service.
You agree that you act for yourself and not as an agent or representative of Hyrr in any transaction.
4 - Governing Law
The laws of the United Kingdom, excluding conflicts of law rules, govern these Terms and your use of the Service. Other local, state, national, or international laws may also apply.
4.1 - For European Union (EU) Users
EU consumers benefit from mandatory provisions of their country’s law.
4.2 - United States Legal Compliance
You warrant you are not in a U.S.-embargoed country or on a U.S. prohibited list.
4.3 - Severability
If a provision is unenforceable, it will be interpreted to achieve its intent to the fullest extent under law, with remaining provisions unaffected.
4.4 - Waiver
Failure to exercise a right or require performance does not waive future rights or performance.
5 - User Accounts
5.1 - Account Creation
You must provide accurate, complete, and current information. Failure to do so breaches these Terms and may lead to account termination.
Usernames must not infringe on others’ rights or be offensive.
5.2 - Account Information
You may need to provide your name, email, phone number, address, identity documents, bank details (Owners), or payment details (Renters).
5.3 - Account Review
We do not perform background checks or endorse users unless specified. We aren’t responsible for user-provided information accuracy.
5.4 - Account Password
You are responsible for your password and account activity. Notify us of breaches immediately.
5.5 - Account Termination
We may terminate or suspend your account without notice for any reason, including breaches. You may terminate by discontinuing use or deleting your account.
6 - Content
6.1 - Your Right to Post Content
You may post Content (e.g., listings). You are responsible for its legality and appropriateness. By posting, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, display,reproduce, and distribute it. You retain your rights and must protect them.
You warrant you own the Content or have rights to use it and grant this license, and it doesn’t violate third-party rights.
6.2 - Content Restrictions
You are responsible for your Content and account activity. Prohibited Content includes unlawful, offensive, or infringing material (e.g., spam, malware, discriminatory content).
We may remove objectionable Content, edit its format, or limit your Service use. You use the Service at your own risk; we aren’t liable for user Content.
6.3 - Content Backups
We perform backups but don’t guarantee against data loss. Maintain independent copies.
6.4 - Intellectual Property and Copyright Infringement
We respect IP rights. Notify us of infringement claims via email (hello@hyrr.com) with required details (e.g., signature, description, location). We’ll act as appropriate.
7 - Orders of Goods
By placing an Order, you warrant you can enter binding contracts
7.1 - Position of the Service in Orders
Hyrr facilitates transactions between Owners/Sellers and Renters/Buyers as an intermediary, not a party to user agreements, limiting our liability.
7.2 - Your Information as Renter/Buyer
You may provide information (e.g., name, payment details) for Orders. You warrant its accuracy and your right to use payment methods. We may share this with processors.
7.3 - Availability, Errors, and Inaccuracies
Goods may be mispriced or unavailable. We and Owners may correct errors without notice.
7.4 - Prices Policy
Owners set Hire Fees. Prices may change before acceptance or post-acceptance due to external factors (e.g., shipping costs), allowing cancellation.
7.5 - Payments
Payments use available methods. Owners receive Hire Fees minus commission within 24 hours of rental start. Late fees may apply (see 7.10).
7.6 - Service Fees
We may charge fees, displayed during Orders, subject to change.
7.7 - Order Modification
You and Owners handle modifications and costs.
7.8 - Order Cancellation
- Our Rights:
We may cancel Orders for availability, errors, fraud, or illegality.
- By Renters/Buyers:
Cancelled Orders are non-refunded unless exceptional (contact us).
If something outside Your control requires You to cancel an Order, or if You think your Order should be refunded, contact Us.
- By Owners/Sellers:
Cancelled Orders refund the Renter/Buyer; Owners receive no payment.
7.9 - Order Dispute
Notify us of disputes. We resolve at our discretion and may charge mediation costs if substantial (see 14.2)
7.10 - Rental-Specific Terms
- Owner Responsibilities:
Ensure Goods are accurately described, safe, and in good condition with at least one image. Set a Replacement Value for loss/damage.
- Renter Responsibilities:
Use best efforts to maintain Goods’ condition, treating them as your own, and return them as received (normal wear excepted) by the rental period’s end via shipping or inperson pickup as agreed.
- Loss or Damage:
You’re liable for loss or damage due to theft, fire, or other causes up to the Replacement Value. We may charge your payment method accordingly.
- Timely Return:
Return Goods by the agreed end date. Late returns revoke your license to use them and incur fees of up to twice the daily Hire Fee per 24-hour period (or portion), plus taxes and recovery costs, until equaling the Replacement Value. We may charge your payment method.
- Delivery Options:
You’re liable for loss or damage due to theft, fire, or other causes up to the Replacement Value. We may charge your payment method accordingly.
Shipping:
Use a tracked, signed-for service (e.g., Royal Mail). Senders (Owners for delivery, Renters for return) bear shipping costs and risks. Share tracking numbers via the Service.
In-Person Pickup:
Coordinate directly with the other party for location and time. Hyrr isn’t liable for pickup issues.
- Fee Avoidance:
Coordinating rentals outside the Service with users met via Hyrr is prohibited. Violators owe double the avoided fees or £200 (whichever is greater) per instance, and we may terminate your account.
8 - Disclaimer of Warranties and Limitation of Liability
8.1 - Limitation of Liability
Our liability is limited to amounts paid through the Service. We aren’t liable for consequential damages (e.g., injury, lost profits) to the maximum extent permitted by law.
8.2 - "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" without warranties of fitness or non-infringement. We don’t guarantee error-free operation.
8.3 - Links to Other Websites
We aren’t responsible for third-party sites linked via the Service.
8.4 - Translation Interpretation
The English version prevails in disputes.
9 - Disputes Resolution about the Service
Resolve Service disputes informally by contacting us first.
10 - Intellectual Property of the Service
The Service’s original content (excluding user Content), features, and functionality are owned by Hyrr and its licensors, protected by law.
11 - Your feedback to Us
You assign all rights in Feedback to us or grant a perpetual, royalty-free license to use it.
12 - Changes to these Terms of Service
We may modify these Terms, providing 30 days’ notice for material changes. Continued use binds you to revisions.
13 - Limitation of Liability for Peer-to-Peer Transactions
13.1 - Hyrr as an Intermediary
Hyrr connects users to rent, sell, or trade Goods without owning or controlling them.
13.2 - No Liability for User Transactions
We aren’t liable for transaction-related damage or loss (e.g., item quality, disputes).
13.3 - User Responsibility
You must evaluate users, ensure item suitability, and resolve disputes directly. Owners ensure Goods are safe and legal.
13.4 - Identity Verification
We may offer verification but don’t guarantee user identity.
13.5 - Indemnification
You indemnify Hyrr against claims from your use, breaches, or infringement.
14 - Dispute Resolution Between Users
14.1 - Direct Resolution
Resolve transaction disputes directly with the other user.
14.2 - Mediation and Costs
We may assist at our discretion but aren’t obligated. If substantial mediation costs arise, we may invoice you a reasonable reimbursement.
14.3 - Release
You release Hyrr from claims related to user disputes.
15 - Rules of Acceptable Use
You may not:
- Harass or abuse others;
- Use automated systems excessively;
- List prohibited Goods (e.g., weapons, hazardous items);
- Engage in Fee Avoidance.
Breaches may lead to suspension or legal action.
